What is an "Attorney Assisted Divorce"?
To get divorced it is necessary to go to Court. A Court must confirm the divorce for it to be valid.
There is no way around this, you have to go to Court even if your divorce is unopposed / uncontested.
You can do an unopposed / uncontested divorce on your own in the Regional Magistrates’ Courts but the procedure you need to follow is the same as an attorney would have to follow. It is complicated; requires many visits to the Court; and, takes up a lot of time (in particular, personal time, much of which is just waiting around).
To avoid the hassle, inconvenience and possible delays, iLawyer has partner Law Firms that can handle the unopposed Court process for you at a markedly reduced cost to using a regular attorney (see the top of the page for price). We call this product an Attorney Assisted Divorce.
The Attorney Assisted Divorce product means an attorney will handle all the Court requirements to get the divorce completed in the Courts.
The cost of the Attorney Assisted Divorce product does not include disbursements such as:
- The cost of the Sheriff to serve the Summons, which is about R300 – R500.
- The cost of the final day in court with the Judge to confirm the Divorce, which is about R1,500.
These costs will be billed later when they need to be paid.

Yes.
A Divorce Settlement Agreement must have been agreed or signed by both Parties to use this Attorney Assisted Divorce Option.
This option can only work if the Divorce is completely uncontested and unopposed.
Your Divorce Settlement Agreement must deal with all the aspects of Divorce required by the Courts, such as:- Assets, Liabilities, Minor Children’s Interests, Access to Minor Children, Financial Maintenance of Minor Children, Spousal Maintenance, etc.

Can I use iLawyer's Attorney Assisted Divorce product if my Divorce is Opposed?
No.
This option is only available to people whose Divorce is unopposed or uncontested.
How long does an unopposed / uncontested divorce take?
The process will not take less than 4 months.
Are "Unopposed" and "Uncontested" Divorces the same"?
Basically, Yes.
There are differences, but iLawyer uses the terms interchangeably because it is assumed you and your spouse have agreed on the terms of your Divorce and have a Divorce Settlement Agreement that is signed, or ready to be signed.
